Iroquois Sheriff Dept. Settles Federal Civil Suit…

By John Kraft & Kirk Allen

On April 24, 2013

IROQUOIS CO. (ECWd) –

In a complaint filed on June 3, 2011 in the U.S. District Court, Central District, Iroquois County Sheriff Deputy Shon Johnson was the named defendant in a lawsuit claiming violations of Mr. Corey Kilgore’s constitutional rights under the 4th, 5th, 6th, and 8th amendments.

This complaint alleged that the Illinois State Police arrested Mr. Kilgore on January 5, 2011 and that Deputy Johnson was waiting outside the Iroquois County Jail when officers arrived to deliver Kilgore to the county.

In the process of booking, Kilgore states that he was dragged out of the patrol car, dragged up the stairs, dragged down the hallway and placed in a holding cell. He also states he asked to use the restroom, but was ignored and had to urinate in the floor drain. The complaint futher states Deputy Johnson entered the holding cell and shoved Kilgore’s head into the steel bench and was choking Kilgore in the process, and he lost consciousness. Kilgore also complained of verbal insulting and berating comment several more times.

Kilgore finally states that during check-out through the bail process, Deputy Johnson was taunting Kilgore with “extreme” verbal commands.

Deputy Johnson, in written response to the complaint,  denied all accusations, but on March 18, 2013 a settlement was reached between both parties.

We have served a FOIA request for the settlement and will provide that information when we have a copy.

How much more crap can this county tolerate? At some point our laws have to be enforced and when those that don’t enforce them we need to stand up and throw them out of office!
